PART A: OVERVIEW AND DEFINITIONS

 

1.      This document titled JCBL General Terms and Conditions contains the terms and conditions that are applicable to all the services (“JCBL Services”) that JCBL offers to you or to any of its customers across any or all of its platforms (“JCBL Platforms”). The JCBL General Terms and Conditions may be changed or amended by JCBL from time to time with or without prior notice and updated on the jcblgroup.net (“JCBL Website”)

 

2.      You are required to read and familiarize yourself with these terms and conditions and your continued use of any of JCBL Services or the use of JCBL Platforms or any or all of the functionalities of JCBL Platforms is an automatic confirmation of the fact that you have read, understood and accepted all the terms and conditions laid down in this document titled JCBL General Terms and Conditions as well as the updated Terms and conditions on the jcblgroup.net website.

 

 3.      “JCBL Services”: JCBL Services are services that JCBL provides to you through any of its platforms (“JCBL Platforms”). These services are provided to you by JCBL in its role only as an intermediary and a service provider. JCBL Services may include but not be limited to selling and distribution of products and services of the JCBL Partner Institutions. JCBL is authorized to make available, sell and distribute the products of JCBL Partner Institutions to you through agreements and arrangements JCBL has with the JCBL Partner institutions. JCBL is not a financial institution and is not governed by the UAE Central Bank. As such, JCBL does not have and is not authorized to have or sell financial products of its own.

 

4.      The “JCBL Partner Institutions”: JCBL Partner Institutions are entities that JCBL has sales or distribution arrangements and agreements with. Through these agreements, JCBL is authorized to make available and sell to you specific products and services provided by the JCBL Partner Institutions. The JCBL Partner Institutions include but may not be limited to banks, financial Institutions and finance companies registered in the UAE or in any other country or geography. JCBL Partner Institutions may include any entity that provides any products or services with whom JCBL has an agreement to sell or distribute the products or services provided by that entity. The list or set of JCBL Partner Institutions may increase or decrease from time to time as JCBL gets into new agreements with newer entities or gets out of an existing agreement with an entity.

 

5.      “JCBL Platforms”: JCBL Platforms include any mode of interaction that you use to interface with JCBL and vice versa or JCBL uses to interface and interact with the JCBL Partner Institutions and vice versa. JCBL Platforms may include but not be limited to mobile applications “JCBL App”, website (“JCBL Website”), interface over the phone, SMS, physical interface through in person meetings by JCBL representatives, mail, e-mail and social media platforms including Whatsapp.

 

 

 

PART B: TERMS AND CONDITIONS OF GENERAL APPLICATION

 

1.      When you use JCBL Services to apply for a product or service of a JCBL Partner Institution, you will be asked to and be required to provide a certain set of your data, information and documents, including your financial information, identification documents like Emirates ID and passport and any other national ID, (collectively “Customer Data”) to JCBL about yourself through any of JCBL Platforms. This data and information that you provide to JCBL may be used to register you as a JCBL customer and create a JCBL customer account for you (“JCBL ID”). You expressly authorize JCBL to store the data, information and documents that you provide to JCBL through any JCBL Platform and for JCBL use it in accordance with the terms and conditions laid out in this document as well as the JCBL Privacy Policy that is available on the JCBL Website. Customer Data that you will be required to provide in order to use JCBL Services to apply for products of JCBL Partner Institutions may include Customer Data asked for by any or all of JCBL Partner Institutions in the format of the respective JCBL Partner Institution. JCBL reserves the right to reject your registration as a JCBL customer or to let you proceed with use of JCBL Services for any reason whatsoever.

 

2.      JCBL may pass on Customer Data to any of the JCBL Partner Institutions of its choice including but not limited to the JCBL Partner Institution that you have indicated as your choice for applying for a product through any of the JCBL Platforms. JCBL Partner Institutions may then use Customer Data to assess and evaluate your application and carry out investigations as they deem appropriate to approve or decline your application. The final decision on the approval of any financial product or credit facilities including approval and issuance of credit cards, as well as the subsequent sanction of any Credit card limit or approval of any loan and as well as the extent of the loan amount approved will all be done at the sole discretion of the respective JCBL Partner Institutions to which Customer Data have been sent and the application has been made, and is subject to that JCBL Partner Institution’s policy and guidelines. Please note that JCBL provides no assurance of approval in this regard, and is merely an intermediary and a service provider enabling and assisting you (the customer /applicant) in the associated application process. Any loan amounts or credit card limits or any other preliminary approval amounts indicated through any of JCBL platforms will only be purely illustrative in nature and not an assured amount. In this process of assessment, JCBL Partner Institutions may ask you for additional Customer Data as well as documents from you directly or through JCBL.

 

3.      You hereby agree and acknowledge that while using JCBL Services and JCBL Platforms, JCBL may carry out its own verifications of Customer Data. These verifications may include but not be limited to mobile number verification by way of one time password (OTP) being sent to the mobile number you provide to JCBL. JCBL Platforms may also ask you to provide with your photograph either by way of a file upload or directly by the use of camera features built in any of the JCBL Platforms. These photos may be used to match with the photos on your documents including your Emirates ID. While using JCBL Services through any JCBL Platform, you may also be required to capture a video of yourself for a video consent and as proof of your using JCBL Platforms. JCBL Platforms may also have other security features like geographic location identification.

 

4.      JCBL Services are provided by JCBL only as an intermediary between you the customer/applicant and JCBL Partner Institutions. As a part of your using JCBL Services to apply for the products of JCBL Partner Institutions, JCBL Partner Institutions may also ask you to fill their own application forms for the products you apply for and those application forms may carry their own set of terms and conditions that the JCBL Partner Institutions will and do want you to read understand and accept as a part of the application process. By using JCBL Services through any JCBL Platform, you understand and acknowledge that during the application process and further whether the JCBL Partner Institution approves or declines your application, nothing will ever constitute a tripartite agreement between you, JCBL and any JCBL Partner Institution during the application process or thereafter. You acknowledge that JCBL will not be liable for any claims arising out of any dispute between you and JCBL Partner Institutions.

 

5.      You acknowledge that while acting as an intermediary between you and the JCBL Partner Institutions, JCBL will make every attempt on a best effort basis to make sure that the description of the products and services of the JCBL Partner Institutions is accurate at a point in time, the JCBL Partner Institutions may change the description and features of the products and services they provide from time to time and you acknowledge that you will independently keep yourself updated of these descriptions and features and their suitability to your needs including any changes therein for a product or service of any JCBL Partner Institution.

 

6.      By using JCBL Services through any JCBL Platform you certify that the Customer Data you provide including any documents like Emirates ID copy, Passport copy, income and employment documents and proof, bank statements etc, are true and correct and that you shall advise JCBL in writing of any changes thereto. You also expressly authorize JCBL at its discretion to collect, use and store your Customer Data and any information that JCBL may get from JCBL Partner Institutions or from institutions like credit bureaus and banks including international credit bureaus and banks in any geography for whatever purposes it may require including sending it to JCBL Partner Institutions for the purposes laid down in this document and also for data processing, marketing and selling products of JCBL Partner Institutions to you, and for statistical and risk analysis purposes or to comply with the applicable laws, rules and regulations. By use of JCBL Services you also irrevocably and unconditionally authorize JCBL to make inquiries with, obtain my information from or supply my information to any bank or financial institution including JCBL Partner Institutions or credit bureau or credit reporting agency in any jurisdiction for any purpose relating to but not limited to your financial position, employment, income or credit history.

 

7.      By use of JCBL Services you also authorize JCBL to use your Customer Data you provide to JCBL including names and contact details of any references you provide to contact you or the references by any means for verification as well as to send you promotional or marketing materials through any JCBL Platform or over mail, e-mail, SMS, social media, phone,  or any other means of communication. You also authorize JCBL to contact you by any means of communication including JCBL Platforms, JCBL employees, representatives and agents, unless specifically informed to us in writing by you or the references to not do so.

 

8.      You acknowledge and certify that while using JCBL Services, you have satisfied yourself entirely that you are competent to use JCBL Services to apply for products of JCBL Partner Institutions with respect to all UAE laws as well as laws of any other jurisdiction that you may be subjected to. You also hereby acknowledge and certify that you understand that JCBL will not be responsible in any way for any claims by anyone against you arising out of your use of JCBL Services as well as any JCBL Platform. You certify that you will use JCBL Services and JCBL Platforms in accordance with all applicable laws.

 

9.      You acknowledge and certify that you will use JCBL Services and JCBL Platforms securely and that all verification processes on JCBL Platforms like mobile number and OTP verification, Emirates ID photo match, video KYC etc will be done by you to prevent impersonation by someone else on your behalf. You also certify and acknowledge that you understand that there is a certain amount of risk associated with transmitting or providing your data by the use of JCBL Platforms and that by continuing to use JCBL Services or JCBL Platforms, you accept that risk and agree to keep JCBL and JCBL Partner Institutions indemnified against any loss incurred by you or them in this regard. You also agree to keep JCBL and JCBL Partner Institutions indemnified against any malfunction of JCBL Platforms including but not limited to conditions of Force Majeure.

 

10.   You acknowledge that the terms and conditions of this document will remain in force at all times during your use of JCBL Services and Platforms as well as after you have stopped using them.

 

11.   Termination: You acknowledge that your use of JCBL Services or JCBL Platforms may be terminated by JCBL in the event of breach of any terms and conditions laid down in this document. Your use of JCBL Services and JCBL Platforms may also be terminated by JCBL at its sole discretion without providing any reasons whatsoever.

 

12.   You acknowledge that the terms and conditions of this document may not be terminated or amended without prior written consent by JCBL. These terms and conditions will hold for all JCBL Services and JCBL Platforms including any future JCBL Services and JCBL Platforms.

 

13.   You acknowledge and understand that any communication between JCBL or its employees, representatives or agents, through any JCBL Platform including over phone may be recorded. Such recording will be in accordance with applicable laws. At any time including upon your stopping use of JCBL Services, such recording may be disclosed to JCBL Partner Institutions and also used as evidence in legal proceedings.

 

14.   Fees and charges: From time to time, JCBL may apply fees and charges to be paid by you to JCBL. These fees and charges will be informed to you by way of information available on the JCBL Platform that you use. These fees and charges will be of a non-refundable nature.

 

15.   You warrant that you will use JCBL Platforms only to use JCBL Services and for your own personal use. You also warrant that you will not make any attempt to disrupt any of JCBL Platforms especially the JCBL App or the JCBL Website by way of any virus or malware or hacking or other technology or in any other manner.

 

16.   Force Majeure: JCBL will not be responsible or liable to you for any delay or failure in performing its obligations under this agreement if such performance is hindered due to events beyond the reasonable control of JCBL including without limitation, acts of God, government regulations, acts of third parties including but not limited to JCBL Partner Institutions, war, terrorism, strikes, labor disputes, civil disturbances, natural calamities, or disruptions or breach in power, telecommunication and internet systems.

 

17.   Governing Law and Dispute Resolution: The terms and conditions laid down in this document titled “JCBL General Terms and Conditions” will be subject to and be governed by the laws of the United Arab Emirates. Any dispute or legal proceedings in connection with this document will be subject to the jurisdiction civil courts of Dubai.

 

 

 

PART C: CREDIT BUREAU CONSENT

 

1.      In relation to your use of JCBL Platforms or JCBL Services, you hereby irrevocably and unconditionally consent to permits and authorizes JCBL to:

 

a.      Share or provide your information that you have provided to JCBL through the use of any of JCBL Platforms or JCBL Services, to any Credit Bureau(s) based in any geography, country or jurisdiction including but not limited to Al Etihad Credit Bureau Company (all such entities collectively referred to as “Credit Bureaus” for the purposes of this agreement). Such information may include but not be limited to personal information, financial or credit information.

 

b.      Obtain or access any of your information including but not limited to personal information, financial information or credit performance information from or by the use of any Credit Bureau’s services or database.

 

c.       Use your information so obtained to carry out activities including but not limited to data analytics, providing your information so obtained to share with JCBL Partner Institutions, to assess your suitability or approval or rejection for a financial product through any of JCBL Partner Institutions, sharing your information so obtained from any Credit Bureaus with JCBL employees, affiliates, agents, any third parties that JCBL has appropriate arrangements with wherever situated, or for any other activity relating to your application for a financial product through JCBL or the use of any of JCBL Platforms or JCBL Services.

 

2.      You understand and acknowledge that this Credit Bureau Consent shall remain in force at all times and may not be terminated by you without the prior written consent of JCBL.

 

3.      You understand and acknowledge that your information provided by JCBL to Credit Bureaus may be used by such Credit Bureaus for storage as well as any data analysis and may also be shared by such Credit Bureaus further with banks, financial or other institutions or affiliates of that Credit Bureaus.

 

4.      You understand and acknowledge that JCBL will provide your information to any Credit Bureaus without any liability on the part of JCBL or liability on the part of JCBL or JCBL Partner Institutions or Directors or Employees or Agents or affiliates of JCBL.

 

5.      You understand and acknowledge that JCBL or any of its directors or employees or JCBL Partner Institutions or JCBL affiliates will not be liable or responsible for any loss or damage incurred by you because of the receipt of any incorrect or incomplete information about you from any Credit Bureaus.

 

PART D: JCBL WALLET AND JCBL CASHBACK POINTS (JCP)

 

The customer expressly acknowledges and accepts the following terms and conditions relating to the JCBL Wallet and the JCBL Cash Back Points:

 

The “JCBL Wallet” or “Wallet” is an integral feature only for all registered customers on JCBL's Platforms. It functions as a virtual repository, exclusively designed to earn, store and accumulate JCBL Cashback Points ("JCP”) for JCBL customers as a part of their profile with JCBL, the JCBL Wallet and Cashpoints may made available to customer from time to time at the sole discretion of JCBL.

 

The Wallet is geared towards enhancing user experience, serving as a platform to manage the JCP earned by JCBL Customers. It is essential to note that the Wallet is not akin to digital cards or wallets for direct purchases outside of the JCBL Platforms or apart from the way JCBL at its sole discretion authorizes the use of the Wallet.

 

3.      JCBL Cashback Points (“JCP”) are rewards given to customers in the form of points by JCBL to customers, prospects and applicants of JCBL for successful accomplishment of certain tasks and stipulated conditions being met by the customer which may include but not be limited to applying for a financial product, referring a customer to JCBL, providing or completing personal and financial information etc. Grant of any JCP any customer is entirely at the sole discretion of JCBL and can be done only if JCBL is satisfied that the conditions laid down by JCBL for the earning of JCP are met successfully by the customer. To serve as an example and highlight the subject matter of this clause: In case JCP are granted to the customer for applying for a product or multiple products through JCBL, JCP will be due only upon successful acceptance of the customers application by a JCBL Partner Institution. Again, as another example: In case JCP are granted to the customer for referring another customer to JCBL, JCP will be due on upon the successful acceptance of the referred person’s application by the JCBL Partner Institution to which such application was sent.

 

 

 

4.      JCP is not akin to actual monetary value in any form or denomination. From time to time JCBL may decide to convert JCPto any monetary value and credit a JCBL customer’s bank account registered with JCBL. Such conversion will only be under conditions stipulated by JCBL at its sole discretion. This conversion ratio of JCP into monetary value will be done at a ratio decided at the sole discretion of JCBL and such ratio may be changed by JCBL at its sole discretion from time to time with or without intimation to JCBL Customers.

 

 

 

5.      Expiry of JCP: JCP may have a shelf life, post which they will expire. Duration to expiry of JCP will be decided by JCBL at its sole discretion and may change from time to time. Expired JCP cannot ordinarily be reinstated. Any reinstatement of expired JCP can be done only at the sole discretion of JCBL.

 

JCP are non-transferable, non-exchangeable, and non-convertible to any tangible monetary value of any nature by the customer unless decided so by JCBL at it’s sole discretion.

 

It is incumbent upon customers to ensure the bank details they decide to register with JCBL are accurate and current. JCBL will not be responsible in any way for any damage or liabilities arising from discrepancies due to inaccurate bank account information provided by the customer to JCBL. Customers might be subjected to transaction fees during JCP conversion to monetary value via credit to their bank account and any such transaction fees will entirely be borne by the customer.

 

Tax implications: JCBL customers must be cognizant of any actual, potential, current or future tax implications that they may be subject to because of earning JCP or their conversion to monetary value in the customer’s hands and any such tax liability or implication will be the sole responsibility of the customer and JCBL will not be liable to any such tax liability or implication. In case of any doubts regarding this, JCBL recommends customers to consult with competent tax authorities or professionals for guidance on this subject and satisfy themselves.

 

9.      JCP and the JCBL Wallet programs may be stopped or dissolved at any time at the sole discretion of JCBL. JCP once credited to the customer’s JCBL Wallet may be withdrawn by JCBL at the sole discretion of JCBL and this may be done at any point of time including after JCP has been granted to the customer if JCBL believes that the conditions required to be completed by the customer were not fulfilled prior to the granting of such JCP.

 

10.   The decision whether the customer has met the conditions required for the grant of any JCP is entirely at the sole discretion of JCBL. Any conversion of any JCP any monetary value or any other items of any value will be entirely at the sole discretion of JCBL.

 

PART E: CUSTOMER DATA AND PRIVACY POLICY

 

 

 

1.      INTRODUCTION

 

1.1          This Privacy Policy sets the terms on which JCBL ("we", "us", or "our") collects, uses, maintains, and discloses your personal information when an individual interacts with us through JCBL Platforms and JCBL Services which may include but not be limited to physical paper base or application form, mobile application, websites or through JCBL employees and agents. Throughout this policy, the term “customer”, "user", “you” or "your" refers to the individual accessing or using our services, or the company, or other legal entity on behalf of which such individual is accessing or using the services, as applicable. We highly prioritize your privacy and are committed not only to safeguarding your personal information but also to helping you understand how and why your information is used. By using our services, you acknowledge your understanding and acceptance of the practices described in this Privacy Policy. Please note that we may periodically update this policy as necessary to reflect changes in our practices or for other operational, legal, or regulatory reasons. The most current version of this policy will always be accessible on our platforms and websites. We encourage you to review this policy frequently to stay informed about our most current data protection practices.

 

 

 

2.      SECURITY MEASURES

 

2.1   At JCBL, we employ security measures to protect Customer Data against unauthorized access, modification, disclosure, or destruction.

 

2.2   Our physical security measures help safeguard the infrastructure that houses Customer Data, including secure data centers and backup systems. We regularly review our security practices, adapting to technological advancements and industry best practices to continually enhance data security.

 

2.3   In order to provide a seamless and efficient service, JCBL may need to transfer and process Customer Data to JCBL Partner Institutions as well as other third parties within the UAE or even across geographical borders. Please be assured that during these transfers, we adhere strictly to all applicable data protection laws and industry best practices to maintain the confidentiality and integrity of Customer Data. While we maintain data protection standards, we want to inform you that the legal requirements regarding data protection can change from time to time and differ from one country to another. Despite these changes and differences, we are committed to safeguarding Customer Data. Your use of JCBL Platforms and JCBL Services, and your decision to provide such information, constitutes your consent to the transfer, storage, and processing of Customer Data as laid down in this clause.

 

2.4   We recognize that you also play a critical role in data security. We advise you to protect your user credentials and avoid sharing them with others. If you suspect any security breach related to your account, please notify us immediately. While no digital platform can guarantee absolute security, we continuously implement and update administrative, technical, and physical security measures to protect your data to the best of our ability.

 

 

 

3.      CUSTOMER DATA WE COLLECT

 

3.1   During the your use of JCBL Platforms and JCBL Services, users will be asked to provide JCBL with certain Customer Data as referenced in Clause 1 of PART A of this document titled JCBL General Terms and Conditions and described in greater detail in the Clause 3.2 of PART E of this document.

 

3.2   Customer Data: Customer Data for the purposes of this document as well as for the purposes of the use of JCBL Services and JCBL Platforms may include but not be limited to your financial information, identification documents like Emirates ID and passport and any other national ID, demographic and personal information including but not limited to name, address, email address and telephone numbers, your financial details including details of financial products you have with other financial institutions, credit and credit bureau information, information of 3rd parties (such as references which may include but not be limited to the contact information of such references your provide), bank account details, income proofs, and credit scores. Customer Data also includes copies of government-issued IDs and documents, including but not limited to identity and address proofs, and other relevant Know Your Customer (KYC) documents, which may be shared or uploaded by you during the application process. Customer Data may also include your data sourced from third parties including but not limited to financial institutions and credit bureaus.

 

Customer Data may also include Usage, Behavioral, and Demographic Information: We collect a broad range of information about how users interact with our platform and services. This includes usage data, such as the specific areas of the platform users visit, the services they access, their IP address, device information, hardware settings, browser details. We also collect behavioral data, which provides insight into the users' activities on our platform, including system activity and mechanisms such as but not limited to the tracking of referral URLs. To provide a more tailored service, we gather demographic information, which includes non-personal information such as age, gender, occupation, interests, and location. All this information plays a crucial role in analyzing the use of our resources, troubleshooting problems, preventing fraud, and ultimately improving our services.

 

3.3   By using or accessing our platform, users agree to our collection, disclosure, and use of Customer Data as described in this document. We may track the collected internet protocol address or mobile device information from user’s interaction or visit to JCBL Platforms and analyze this data for safety and statistical analysis. This information helps us keep JCBL Platforms safe from breaches as well as helps JCBL measure the use of our platform and improve our services. We also want to bring to your attention that our privacy policy does not extend to websites owned or managed by third-parties or for data or information disclosed by the user to third-parties including but not limited to JCBL Partner Institutions. Please note, the use of JCBL Services indicates users' consent to our collection, use, and disclosure of Customer Data as described in this policy.

 

 

 

4.      USAGE, DISSSEMINATION AND RETENTION OF CUSTOMER DATA

 

4.1   JCBL utilizes, analyzes and leverages Customer Data as described in this document to individualize each user's experience on our platform as well as provide superior and faster service and processing. This pertains to, but is not restricted to, Customer Data expressly provided by the user along with Customer Data sourced from other sources including but not limited to financial institutions, credit bureaus and other relevant entities. Furthermore, we may need to share Customer Data with third parties including but not limited to JCBL Partner Institutions, service providers, business associates, financial institutions, JCBL employees and agents or to comply with legal requirements, in strict adherence to applicable laws and regulations. We hold your data in line with the objectives specified in this Privacy Policy or as the law allows, implementing suitable steps to guarantee data safety.

 

4.2   JCBL may partner with trusted third-parties to offer vital services on JCBL Platforms. These third parties might be JCBL Partner Institutions, companies or individuals tasked with data storage and hosting services, marketing assistance and customer support.

 

4.3   JCBL Platforms or use of JCBL Services may feature links to third-party websites or services including but not limited to JCBL Partner Institutions that are not under the direct purview of JCBL. These links are provided for processing your application, but we do not vouch for, assure, or pledge the security of these third-party sites or services. We encourage you to scrutinize the privacy norms and policies of any such third-party sites or services before sharing your Customer Data. Furthermore, use of JCBL Platforms and JCBL Services might necessitate the use of the internet for advertising activities, which could be executed by third-party service providers. These providers could employ internet technologies such as cookies, encoded URLs, and other tracking tools which might gather information, not limited to tracking your interactions, time spent, and pages viewed. JCBL may leverage this compiled and anonymized personal information to generate non-personal, statistical, or aggregated data. This data, could be used for an array of purposes, including but not limited to research, analytics, marketing, and service enhancement.

 

4.4   At JCBL, circumstances may arise where we need to disclose Customer Data during significant business events, including but not limited to mergers or acquisitions. During such events, it may be necessary to transfer Customer Data as part of the proceedings. Be assured, any such actions are always conducted in accordance with applicable data protection laws and with a priority focus on keeping Customer Data secure. In addition, legal obligations may call for the accessibility, retention, and revelation of Customer Data. These actions will be performed by JCBL with an honest attempt to comply with legal mandates, safeguard JCBL’s assets and rights, avert potential misconduct, ensure safety of Customer Data.

 

 

 

5.      USER RIGHTS & GENERAL PROVISIONS

 

5.1   User Rights and Options: As part of our commitment to our users at JCBL, we prioritize your autonomy over Customer Data. This means that you have the ability to view, correct, or delete your information that has been stored with JCBL by informing JCBL in writing or by the use of JCBL Platforms wherever possible. Your providing Customer Data to JCBL is optional in your hands, however, it should be noted that not providing Customer Data or providing incomplete or incorrect Customer Data might limit or restrict certain features and functionalities or may even completely disable the use of JCBL Platforms and JCBL Services. Please note that as part of JCBL using Customer Data to have your application for financial products processed through JCBL Partner Institutions Customer Data may be shared by JCBL with third parties including but not limited to JCBL Partner Institutions and other third parties like financial institutions, banks, and credit bureaus. Customer Data once shared by JCBL with these third parties may not be possible to be deleted or withdrawn or taken back from such third parties.

 

5.2   Communications for Promotion and Marketing: At JCBL, we focus on delivering personalized services, promotions, and experiences. To fulfill this, we might utilize Customer Data to enrich your engagement with our offerings and deliver pertinent promotional or marketing updates. However, we respect your preferences and offer you the ability to opt-out from such communications, either by adhering to the instructions in each communication or by informing JCBL in writing. Please remember that even if you opt-out from promotional communications, essential transactional or administrative messages may still be sent to you from JCBL.

 

5.3   Age Limitation and User Eligibility: The services of JCBL are purposefully crafted for individuals who meet the legal age requirement for financial product acquisition, as specified by the laws of the United Arab Emirates. We stringently implement measures to prevent the gathering of Customer Data from individuals below this age threshold. In any case where Customer Data is inadvertently collected, we promptly take action to expunge it from our systems. If you are a parent or guardian and become aware that your minor child has shared Customer Data with us, we urge you to notify us in writing at the earliest opportunity.

PART A: OVERVIEW AND DEFINITIONS

 

1.      This document titled JCBL General Terms and Conditions contains the terms and conditions that are applicable to all the services (“JCBL Services”) that JCBL offers to you or to any of its customers across any or all of its platforms (“JCBL Platforms”). The JCBL General Terms and Conditions may be changed or amended by JCBL from time to time with or without prior notice and updated on the jcblgroup.net (“JCBL Website”)

 

2.      You are required to read and familiarize yourself with these terms and conditions and your continued use of any of JCBL Services or the use of JCBL Platforms or any or all of the functionalities of JCBL Platforms is an automatic confirmation of the fact that you have read, understood and accepted all the terms and conditions laid down in this document titled JCBL General Terms and Conditions as well as the updated Terms and conditions on the jcblgroup.net website.

 

 3.      “JCBL Services”: JCBL Services are services that JCBL provides to you through any of its platforms (“JCBL Platforms”). These services are provided to you by JCBL in its role only as an intermediary and a service provider. JCBL Services may include but not be limited to selling and distribution of products and services of the JCBL Partner Institutions. JCBL is authorized to make available, sell and distribute the products of JCBL Partner Institutions to you through agreements and arrangements JCBL has with the JCBL Partner institutions. JCBL is not a financial institution and is not governed by the UAE Central Bank. As such, JCBL does not have and is not authorized to have or sell financial products of its own.

 

4.      The “JCBL Partner Institutions”: JCBL Partner Institutions are entities that JCBL has sales or distribution arrangements and agreements with. Through these agreements, JCBL is authorized to make available and sell to you specific products and services provided by the JCBL Partner Institutions. The JCBL Partner Institutions include but may not be limited to banks, financial Institutions and finance companies registered in the UAE or in any other country or geography. JCBL Partner Institutions may include any entity that provides any products or services with whom JCBL has an agreement to sell or distribute the products or services provided by that entity. The list or set of JCBL Partner Institutions may increase or decrease from time to time as JCBL gets into new agreements with newer entities or gets out of an existing agreement with an entity.

 

5.      “JCBL Platforms”: JCBL Platforms include any mode of interaction that you use to interface with JCBL and vice versa or JCBL uses to interface and interact with the JCBL Partner Institutions and vice versa. JCBL Platforms may include but not be limited to mobile applications “JCBL App”, website (“JCBL Website”), interface over the phone, SMS, physical interface through in person meetings by JCBL representatives, mail, e-mail and social media platforms including Whatsapp.

 

 

 

PART B: TERMS AND CONDITIONS OF GENERAL APPLICATION

 

1.      When you use JCBL Services to apply for a product or service of a JCBL Partner Institution, you will be asked to and be required to provide a certain set of your data, information and documents, including your financial information, identification documents like Emirates ID and passport and any other national ID, (collectively “Customer Data”) to JCBL about yourself through any of JCBL Platforms. This data and information that you provide to JCBL may be used to register you as a JCBL customer and create a JCBL customer account for you (“JCBL ID”). You expressly authorize JCBL to store the data, information and documents that you provide to JCBL through any JCBL Platform and for JCBL use it in accordance with the terms and conditions laid out in this document as well as the JCBL Privacy Policy that is available on the JCBL Website. Customer Data that you will be required to provide in order to use JCBL Services to apply for products of JCBL Partner Institutions may include Customer Data asked for by any or all of JCBL Partner Institutions in the format of the respective JCBL Partner Institution. JCBL reserves the right to reject your registration as a JCBL customer or to let you proceed with use of JCBL Services for any reason whatsoever.

 

2.      JCBL may pass on Customer Data to any of the JCBL Partner Institutions of its choice including but not limited to the JCBL Partner Institution that you have indicated as your choice for applying for a product through any of the JCBL Platforms. JCBL Partner Institutions may then use Customer Data to assess and evaluate your application and carry out investigations as they deem appropriate to approve or decline your application. The final decision on the approval of any financial product or credit facilities including approval and issuance of credit cards, as well as the subsequent sanction of any Credit card limit or approval of any loan and as well as the extent of the loan amount approved will all be done at the sole discretion of the respective JCBL Partner Institutions to which Customer Data have been sent and the application has been made, and is subject to that JCBL Partner Institution’s policy and guidelines. Please note that JCBL provides no assurance of approval in this regard, and is merely an intermediary and a service provider enabling and assisting you (the customer /applicant) in the associated application process. Any loan amounts or credit card limits or any other preliminary approval amounts indicated through any of JCBL platforms will only be purely illustrative in nature and not an assured amount. In this process of assessment, JCBL Partner Institutions may ask you for additional Customer Data as well as documents from you directly or through JCBL.

 

3.      You hereby agree and acknowledge that while using JCBL Services and JCBL Platforms, JCBL may carry out its own verifications of Customer Data. These verifications may include but not be limited to mobile number verification by way of one time password (OTP) being sent to the mobile number you provide to JCBL. JCBL Platforms may also ask you to provide with your photograph either by way of a file upload or directly by the use of camera features built in any of the JCBL Platforms. These photos may be used to match with the photos on your documents including your Emirates ID. While using JCBL Services through any JCBL Platform, you may also be required to capture a video of yourself for a video consent and as proof of your using JCBL Platforms. JCBL Platforms may also have other security features like geographic location identification.

 

4.      JCBL Services are provided by JCBL only as an intermediary between you the customer/applicant and JCBL Partner Institutions. As a part of your using JCBL Services to apply for the products of JCBL Partner Institutions, JCBL Partner Institutions may also ask you to fill their own application forms for the products you apply for and those application forms may carry their own set of terms and conditions that the JCBL Partner Institutions will and do want you to read understand and accept as a part of the application process. By using JCBL Services through any JCBL Platform, you understand and acknowledge that during the application process and further whether the JCBL Partner Institution approves or declines your application, nothing will ever constitute a tripartite agreement between you, JCBL and any JCBL Partner Institution during the application process or thereafter. You acknowledge that JCBL will not be liable for any claims arising out of any dispute between you and JCBL Partner Institutions.

 

5.      You acknowledge that while acting as an intermediary between you and the JCBL Partner Institutions, JCBL will make every attempt on a best effort basis to make sure that the description of the products and services of the JCBL Partner Institutions is accurate at a point in time, the JCBL Partner Institutions may change the description and features of the products and services they provide from time to time and you acknowledge that you will independently keep yourself updated of these descriptions and features and their suitability to your needs including any changes therein for a product or service of any JCBL Partner Institution.

 

6.      By using JCBL Services through any JCBL Platform you certify that the Customer Data you provide including any documents like Emirates ID copy, Passport copy, income and employment documents and proof, bank statements etc, are true and correct and that you shall advise JCBL in writing of any changes thereto. You also expressly authorize JCBL at its discretion to collect, use and store your Customer Data and any information that JCBL may get from JCBL Partner Institutions or from institutions like credit bureaus and banks including international credit bureaus and banks in any geography for whatever purposes it may require including sending it to JCBL Partner Institutions for the purposes laid down in this document and also for data processing, marketing and selling products of JCBL Partner Institutions to you, and for statistical and risk analysis purposes or to comply with the applicable laws, rules and regulations. By use of JCBL Services you also irrevocably and unconditionally authorize JCBL to make inquiries with, obtain my information from or supply my information to any bank or financial institution including JCBL Partner Institutions or credit bureau or credit reporting agency in any jurisdiction for any purpose relating to but not limited to your financial position, employment, income or credit history.

 

7.      By use of JCBL Services you also authorize JCBL to use your Customer Data you provide to JCBL including names and contact details of any references you provide to contact you or the references by any means for verification as well as to send you promotional or marketing materials through any JCBL Platform or over mail, e-mail, SMS, social media, phone,  or any other means of communication. You also authorize JCBL to contact you by any means of communication including JCBL Platforms, JCBL employees, representatives and agents, unless specifically informed to us in writing by you or the references to not do so.

 

8.      You acknowledge and certify that while using JCBL Services, you have satisfied yourself entirely that you are competent to use JCBL Services to apply for products of JCBL Partner Institutions with respect to all UAE laws as well as laws of any other jurisdiction that you may be subjected to. You also hereby acknowledge and certify that you understand that JCBL will not be responsible in any way for any claims by anyone against you arising out of your use of JCBL Services as well as any JCBL Platform. You certify that you will use JCBL Services and JCBL Platforms in accordance with all applicable laws.

 

9.      You acknowledge and certify that you will use JCBL Services and JCBL Platforms securely and that all verification processes on JCBL Platforms like mobile number and OTP verification, Emirates ID photo match, video KYC etc will be done by you to prevent impersonation by someone else on your behalf. You also certify and acknowledge that you understand that there is a certain amount of risk associated with transmitting or providing your data by the use of JCBL Platforms and that by continuing to use JCBL Services or JCBL Platforms, you accept that risk and agree to keep JCBL and JCBL Partner Institutions indemnified against any loss incurred by you or them in this regard. You also agree to keep JCBL and JCBL Partner Institutions indemnified against any malfunction of JCBL Platforms including but not limited to conditions of Force Majeure.

 

10.   You acknowledge that the terms and conditions of this document will remain in force at all times during your use of JCBL Services and Platforms as well as after you have stopped using them.

 

11.   Termination: You acknowledge that your use of JCBL Services or JCBL Platforms may be terminated by JCBL in the event of breach of any terms and conditions laid down in this document. Your use of JCBL Services and JCBL Platforms may also be terminated by JCBL at its sole discretion without providing any reasons whatsoever.

 

12.   You acknowledge that the terms and conditions of this document may not be terminated or amended without prior written consent by JCBL. These terms and conditions will hold for all JCBL Services and JCBL Platforms including any future JCBL Services and JCBL Platforms.

 

13.   You acknowledge and understand that any communication between JCBL or its employees, representatives or agents, through any JCBL Platform including over phone may be recorded. Such recording will be in accordance with applicable laws. At any time including upon your stopping use of JCBL Services, such recording may be disclosed to JCBL Partner Institutions and also used as evidence in legal proceedings.

 

14.   Fees and charges: From time to time, JCBL may apply fees and charges to be paid by you to JCBL. These fees and charges will be informed to you by way of information available on the JCBL Platform that you use. These fees and charges will be of a non-refundable nature.

 

15.   You warrant that you will use JCBL Platforms only to use JCBL Services and for your own personal use. You also warrant that you will not make any attempt to disrupt any of JCBL Platforms especially the JCBL App or the JCBL Website by way of any virus or malware or hacking or other technology or in any other manner.

 

16.   Force Majeure: JCBL will not be responsible or liable to you for any delay or failure in performing its obligations under this agreement if such performance is hindered due to events beyond the reasonable control of JCBL including without limitation, acts of God, government regulations, acts of third parties including but not limited to JCBL Partner Institutions, war, terrorism, strikes, labor disputes, civil disturbances, natural calamities, or disruptions or breach in power, telecommunication and internet systems.

 

17.   Governing Law and Dispute Resolution: The terms and conditions laid down in this document titled “JCBL General Terms and Conditions” will be subject to and be governed by the laws of the United Arab Emirates. Any dispute or legal proceedings in connection with this document will be subject to the jurisdiction civil courts of Dubai.

 

 

 

PART C: CREDIT BUREAU CONSENT

 

1.      In relation to your use of JCBL Platforms or JCBL Services, you hereby irrevocably and unconditionally consent to permits and authorizes JCBL to:

 

a.      Share or provide your information that you have provided to JCBL through the use of any of JCBL Platforms or JCBL Services, to any Credit Bureau(s) based in any geography, country or jurisdiction including but not limited to Al Etihad Credit Bureau Company (all such entities collectively referred to as “Credit Bureaus” for the purposes of this agreement). Such information may include but not be limited to personal information, financial or credit information.

 

b.      Obtain or access any of your information including but not limited to personal information, financial information or credit performance information from or by the use of any Credit Bureau’s services or database.

 

c.       Use your information so obtained to carry out activities including but not limited to data analytics, providing your information so obtained to share with JCBL Partner Institutions, to assess your suitability or approval or rejection for a financial product through any of JCBL Partner Institutions, sharing your information so obtained from any Credit Bureaus with JCBL employees, affiliates, agents, any third parties that JCBL has appropriate arrangements with wherever situated, or for any other activity relating to your application for a financial product through JCBL or the use of any of JCBL Platforms or JCBL Services.

 

2.      You understand and acknowledge that this Credit Bureau Consent shall remain in force at all times and may not be terminated by you without the prior written consent of JCBL.

 

3.      You understand and acknowledge that your information provided by JCBL to Credit Bureaus may be used by such Credit Bureaus for storage as well as any data analysis and may also be shared by such Credit Bureaus further with banks, financial or other institutions or affiliates of that Credit Bureaus.

 

4.      You understand and acknowledge that JCBL will provide your information to any Credit Bureaus without any liability on the part of JCBL or liability on the part of JCBL or JCBL Partner Institutions or Directors or Employees or Agents or affiliates of JCBL.

 

5.      You understand and acknowledge that JCBL or any of its directors or employees or JCBL Partner Institutions or JCBL affiliates will not be liable or responsible for any loss or damage incurred by you because of the receipt of any incorrect or incomplete information about you from any Credit Bureaus.

 

PART D: JCBL WALLET AND JCBL CASHBACK POINTS (JCP)

 

The customer expressly acknowledges and accepts the following terms and conditions relating to the JCBL Wallet and the JCBL Cash Back Points:

 

The “JCBL Wallet” or “Wallet” is an integral feature only for all registered customers on JCBL's Platforms. It functions as a virtual repository, exclusively designed to earn, store and accumulate JCBL Cashback Points ("JCP”) for JCBL customers as a part of their profile with JCBL, the JCBL Wallet and Cashpoints may made available to customer from time to time at the sole discretion of JCBL.

 

The Wallet is geared towards enhancing user experience, serving as a platform to manage the JCP earned by JCBL Customers. It is essential to note that the Wallet is not akin to digital cards or wallets for direct purchases outside of the JCBL Platforms or apart from the way JCBL at its sole discretion authorizes the use of the Wallet.

 

3.      JCBL Cashback Points (“JCP”) are rewards given to customers in the form of points by JCBL to customers, prospects and applicants of JCBL for successful accomplishment of certain tasks and stipulated conditions being met by the customer which may include but not be limited to applying for a financial product, referring a customer to JCBL, providing or completing personal and financial information etc. Grant of any JCP any customer is entirely at the sole discretion of JCBL and can be done only if JCBL is satisfied that the conditions laid down by JCBL for the earning of JCP are met successfully by the customer. To serve as an example and highlight the subject matter of this clause: In case JCP are granted to the customer for applying for a product or multiple products through JCBL, JCP will be due only upon successful acceptance of the customers application by a JCBL Partner Institution. Again, as another example: In case JCP are granted to the customer for referring another customer to JCBL, JCP will be due on upon the successful acceptance of the referred person’s application by the JCBL Partner Institution to which such application was sent.

 

 

 

4.      JCP is not akin to actual monetary value in any form or denomination. From time to time JCBL may decide to convert JCPto any monetary value and credit a JCBL customer’s bank account registered with JCBL. Such conversion will only be under conditions stipulated by JCBL at its sole discretion. This conversion ratio of JCP into monetary value will be done at a ratio decided at the sole discretion of JCBL and such ratio may be changed by JCBL at its sole discretion from time to time with or without intimation to JCBL Customers.

 

 

 

5.      Expiry of JCP: JCP may have a shelf life, post which they will expire. Duration to expiry of JCP will be decided by JCBL at its sole discretion and may change from time to time. Expired JCP cannot ordinarily be reinstated. Any reinstatement of expired JCP can be done only at the sole discretion of JCBL.

 

JCP are non-transferable, non-exchangeable, and non-convertible to any tangible monetary value of any nature by the customer unless decided so by JCBL at it’s sole discretion.

 

It is incumbent upon customers to ensure the bank details they decide to register with JCBL are accurate and current. JCBL will not be responsible in any way for any damage or liabilities arising from discrepancies due to inaccurate bank account information provided by the customer to JCBL. Customers might be subjected to transaction fees during JCP conversion to monetary value via credit to their bank account and any such transaction fees will entirely be borne by the customer.

 

Tax implications: JCBL customers must be cognizant of any actual, potential, current or future tax implications that they may be subject to because of earning JCP or their conversion to monetary value in the customer’s hands and any such tax liability or implication will be the sole responsibility of the customer and JCBL will not be liable to any such tax liability or implication. In case of any doubts regarding this, JCBL recommends customers to consult with competent tax authorities or professionals for guidance on this subject and satisfy themselves.

 

9.      JCP and the JCBL Wallet programs may be stopped or dissolved at any time at the sole discretion of JCBL. JCP once credited to the customer’s JCBL Wallet may be withdrawn by JCBL at the sole discretion of JCBL and this may be done at any point of time including after JCP has been granted to the customer if JCBL believes that the conditions required to be completed by the customer were not fulfilled prior to the granting of such JCP.

 

10.   The decision whether the customer has met the conditions required for the grant of any JCP is entirely at the sole discretion of JCBL. Any conversion of any JCP any monetary value or any other items of any value will be entirely at the sole discretion of JCBL.

 

PART E: CUSTOMER DATA AND PRIVACY POLICY

 

 

 

1.      INTRODUCTION

 

1.1          This Privacy Policy sets the terms on which JCBL ("we", "us", or "our") collects, uses, maintains, and discloses your personal information when an individual interacts with us through JCBL Platforms and JCBL Services which may include but not be limited to physical paper base or application form, mobile application, websites or through JCBL employees and agents. Throughout this policy, the term “customer”, "user", “you” or "your" refers to the individual accessing or using our services, or the company, or other legal entity on behalf of which such individual is accessing or using the services, as applicable. We highly prioritize your privacy and are committed not only to safeguarding your personal information but also to helping you understand how and why your information is used. By using our services, you acknowledge your understanding and acceptance of the practices described in this Privacy Policy. Please note that we may periodically update this policy as necessary to reflect changes in our practices or for other operational, legal, or regulatory reasons. The most current version of this policy will always be accessible on our platforms and websites. 2.3   In order to provide a seamless and efficient service, JCBL may need to transfer and process Customer Data to JCBL Partner Institutions as well as other third parties within the UAE or even across geographical borders. Please be assured that during these transfers, we adhere strictly to all applicable data protection laws and industry best practices to maintain the confidentiality and integrity of Customer Data. While we maintain data protection standards, we want to inform you that the legal requirements regarding data protection can change from time to time and differ from one country to another. Despite these changes and differences, we are committed to safeguarding Customer Data. Your use of JCBL Platforms and JCBL Services, and your decision to provide such information, constitutes your consent to the transfer, storage, and processing of Customer Data as laid down in this clause.

 

2.4   We recognize that you also play a critical role in data security. We advise you to protect your user credentials and avoid sharing them with others. If you suspect any security breach related to your account, please notify us immediately. While no digital platform can guarantee absolute security, we continuously implement and update administrative, technical, and physical security measures to protect your data to the best of our ability.

 

 

 

3.      CUSTOMER DATA WE COLLECT

 

3.1   During the your use of JCBL Platforms and JCBL Services, users will be asked to provide JCBL with certain Customer Data as referenced in Clause 1 of PART A of this document titled JCBL General Terms and Conditions and described in greater detail in the Clause 3.2 of PART E of this document.

 

3.2   Customer Data: Customer Data for the purposes of this document as well as for the purposes of the use of JCBL Services and JCBL Platforms may include but not be limited to your financial information, identification documents like Emirates ID and passport and any other national ID, demographic and personal information including but not limited to name, address, email address and telephone numbers, your financial details including details of financial products you have with other financial institutions, credit and credit bureau information, information of 3rd parties (such as references which may include but not be limited to the contact information of such references your provide), bank account details, income proofs, and credit scores. Customer Data also includes copies of government-issued IDs and documents, including but not limited to identity and address proofs, and other relevant Know Your Customer (KYC) documents, which may be shared or uploaded by you during the application process. Customer Data may also include your data sourced from third parties including but not limited to financial institutions and credit bureaus.

 

Customer Data may also include Usage, Behavioral, and Demographic Information: We collect a broad range of information about how users interact with our platform and services. This includes usage data, such as the specific areas of the platform users visit, the services they access, their IP address, device information, hardware settings, browser details. We also collect behavioral data, which provides insight into the users' activities on our platform, including system activity and mechanisms such as but not limited to the tracking of referral URLs. To provide a more tailored service, we gather demographic information, which includes non-personal information such as age, gender, occupation, interests, and location. All this information plays a crucial role in analyzing the use of our resources, troubleshooting problems, preventing fraud, and ultimately improving our services.

 

3.3   By using or accessing our platform, users agree to our collection, disclosure, and use of Customer Data as described in this document. We may track the collected internet protocol address or mobile device information from user’s interaction or visit to JCBL Platforms and analyze this data for safety and statistical analysis. This information helps us keep JCBL Platforms safe from breaches as well as helps JCBL measure the use of our platform and improve our services. We also want to bring to your attention that our privacy policy does not extend to websites owned or managed by third-parties or for data or information disclosed by the user to third-parties including but not limited to JCBL Partner Institutions. Please note, the use of JCBL Services indicates users' consent to our collection, use, and disclosure of Customer Data as described in this policy.

 

 

 

4.      USAGE, DISSSEMINATION AND RETENTION OF CUSTOMER DATA

 

4.1   JCBL utilizes, analyzes and leverages Customer Data as described in this document to individualize each user's experience on our platform as well as provide superior and faster service and processing. This pertains to, but is not restricted to, Customer Data expressly provided by the user along with Customer Data sourced from other sources including but not limited to financial institutions, credit bureaus and other relevant entities. Furthermore, we may need to share Customer Data with third parties including but not limited to JCBL Partner Institutions, service providers, business associates, financial institutions, JCBL employees and agents or to comply with legal requirements, in strict adherence to applicable laws and regulations. We hold your data in line with the objectives specified in this Privacy Policy or as the law allows, implementing suitable steps to guarantee data safety.

 

4.2   JCBL may partner with trusted third-parties to offer vital services on JCBL Platforms. These third parties might be JCBL Partner Institutions, companies or individuals tasked with data storage and hosting services, marketing assistance and customer support.

 

4.3   JCBL Platforms or use of JCBL Services may feature links to third-party websites or services including but not limited to JCBL Partner Institutions that are not under the direct purview of JCBL. These links are provided for processing your application, but we do not vouch for, assure, or pledge the security of these third-party sites or services. We encourage you to scrutinize the privacy norms and policies of any such third-party sites or services before sharing your Customer Data. Furthermore, use of JCBL Platforms and JCBL Services might necessitate the use of the internet for advertising activities, which could be executed by third-party service providers. These providers could employ internet technologies such as cookies, encoded URLs, and other tracking tools which might gather information, not limited to tracking your interactions, time spent, and pages viewed.
